A FORMER Murray Bridge councillor is asking the council to refund legal fees he incurred during a dispute with the council’s former chief executive officer, Damien Moloney, last year.
Former councillor and Deputy Mayor Phil Nutt has asked the council to refund the $992 he spent on lawyers during a long running clash with former chief executive officer (CEO).
Mr Nutt said he, along with Crs Clem Schubert and June Phillips, contracted Griffins Lawyers to represent them during the dispute in which they were alleged to have made allegations against Mr Moloney.
“We were pursuing our normal council duties and we felt we were under threat and it was necessary to get legal advice,” Mr Nutt said.
“The council was getting high power legal advice so we thought it was necessary to protect ourselves.”
Mr Nutt, Mr Moloney, Cr Phillips and Cr Schubert have never commented publicly on the content of the alleged allegations.
Mr Nutt said last week he could not comment on the content of the allegations because he believed he was still bound by the council’s confidentiality rules, but he said he hoped all would eventually be revealed.
However, Mr Nutt, Cr Phillips and Cr Schubert repeatedly denied making allegations against Mr Moloney when he was CEO.
The council received Mr Nutt’s request during a confidential session at its January 30 meeting but has yet to make a decision on whether or not to reimburse the ex-member.
The council has agreed to pay up to $1000 worth of legal fees incurred by Cr Schubert over the same incident, however, the councillor has yet to claim the funds.
Cr Phillips has had a similar request denied.
Mr Moloney is currently suing the Rural City of Murray Bridge for $166,800 worth of entitlements following his sacking in December.
